GDPR

What is GDPR all about?

European union (E.U) has decided to create an overall framework for data protection and individual's privacy. It's called GDPR.

It stands for: General Data Protection Regulation. Aka GDPR.

GDPR applies to all type of businesses using personal data, which means, anything that may identify an individual such as:

a) cookies;

b) IP and email addresses;

c) and postal code that are stored digitally.

All online data related with individuals and employees will be considered by GDPR. In your personal interest read our private policy.

Email marketing activities

If you take the time to read GDPR website, on their email marketing page section, you'll noticed that there isn't a detailed explanation regards to email marketing activities. Things like what is allowed and not allowed are barely covered, they however mention some rights.

We try to explain and simplify it further.

"Individuals’ rights"

It says, that you should check your procedures to ensure they cover all the rights individuals have. This should include, how you would delete personal data in case you were asked or provide data electronically and in a commonly used format.

As business we should review and display how we seek, record and manage data consent and whether we need to make any changes.

GDPR does allow businesses with a justified/legitimate interest in e-mail marketing, AKA ‘cold’ calling, to act or sent marketing e-mails to potential prospects/customers without thier consent. This is based on the Art. 21(2), (3) GDPR, howwever, the data subject (the receiver) always has the right to object the processing of personal data for direct marketing purposes.

Keep in mind, though, that the definition of legitimate interest is still an ongoing debate. Thus, GDPR requires the sender (s) to justify that a given communication is in the legitimate interest of the contacted business and does not risk the privacy of the individual in any shape or form. ‘Legitimate interest’ should not be used as a reason to ‘catch-all-and-carry-on-regardless’. At least this part is clear.

DMA further guidance

A business guideline is provided by DMA suggesting a clear 3-step process to decide if legitimate interest applies:

  1. Identify a legitimate interest. It’s considered okay if there is a business interest on the part of the sender, as long as this is clearly pointed to the recipient.
  2. Ask, is it necessary? A business objective can determine a necessity, but there's a clear difference between what is considered necessary and useful. That still remains unclear.
  3. Strike a balance. Do the recipients’ rights override the sender’s interests in sending the email?

Ongoing GDPR talks:

We are aware of the GDPR guidelines and we do respect individual's privacy.

They also mentioned that "regardless of whether a company bases its marketing measures afterwards on its legitimate interest or on consent, the controller has to adhere to the data subject’s right to be informed. The content of said information depends on which justification reason is used."

Hope you got that. 🙂

One must wait to see whether the coming ePrivacy Regulation provides more clarity about this issue.
